La militante antiraciste et artiste afro-américaine, Joséphine Baker, entrera au Panthéon le 30 novembre prochain. Naturalisée française en 1937, elle restera ainsi à jamais une figure marquante de la lutte antiraciste, antisémite et féministe ainsi que de la Résistance en France. La question de l’accueil des réfugiés afghans en France ravive les débats sur l’immigration, l’islamisme et le droit d’asile. En effet, nombreux sont les responsables politiques, notamment de droite et d’extrême droite, à craindre que la France accueille aussi sur son territoire des terroristes islamistes cherchant à y commettre des attentats. Les critiques sont nombreuses envers l’action du président de la République Emmanuel Macron. Il est accusé d’une part de cruauté, notamment par la gauche, après avoir déclaré face à la crise humanitaire afghane qu’une « immigration contrôlée » serait mise en place et que la France devait aussi se protéger des « flux migratoires irréguliers », et d’autre part de laxisme, voire de naïveté, par la droite et l’extrême droite, quant à l’arrivée sur le territoire de plusieurs centaines de réfugiés afghans parmi lesquels pourraient se cacher des terroristes. Toutefois, nombreux sont ceux dans la société civile qui appellent à accueillir le plus d’Afghans possibles et notamment ceux ayant aidé l’armée française face aux talibans, à l’image la Commission nationale consultative des droits de l’Homme ayant appelé la France à être « à la hauteur ». Parallèlement aux débats en cours, les gestes de solidarité se multiplient, portés notamment par des maires de gauche qui ont choisi d’accueillir ces réfugiés dans leur commune et où les dons de vêtements à destination des réfugiés ne cessent d’augmenter. Naturalized in France in 1937, she will remain a key figure in the anti-racist, anti-Semitic and feminist struggle as well as in the French Resistance. The issue of the reception of Afghan refugees in France has revived debates on immigration, Islamism and the right to asylum. Indeed, many politicians, particularly on the right and the extreme right, fear that France is also welcoming Islamic terrorists seeking to commit attacks on its territory. There are many critics of the action of the President of the Republic Emmanuel Macron. On the one hand, he is accused of cruelty, notably by the left, after having declared in the face of the Afghan humanitarian crisis that a "controlled immigration" would be put in place and that France should also protect itself from "irregular migratory flows", and on the other hand of laxity, or even naivety, by the right and the extreme right, regarding the arrival on the territory of several hundred Afghan refugees among whom terrorists might be hiding. However, there are many in civil society who call for the reception of as many Afghans as possible, especially those who helped the French army against the Taliban, such as the National Consultative Commission on Human Rights, which called on France to be "up to the task". In parallel to the current debates, gestures of solidarity are multiplying, notably by left-wing mayors who have chosen to welcome these refugees in their municipalities and where donations of clothes for refugees are constantly increasing.

Résistante, militante antiraciste et antisémitisme, féministe, ancienne ambassadrice de la Ligue internationale contre le racisme et l’antisémitisme (Licra), elle sera la première femme noire à entrer au Panthéon.

Josephine Baker will be inducted into the Pantheon on 30 November. Born in the United States in 1906, she fell in love with France and was naturalised in 1937. A resistance fighter, anti-racist and anti-Semitic activist, feminist and former ambassador of the International League against Racism and Anti-Semitism (Licra), she will be the first black woman to enter the Pantheon.

Après la diffusion par la chaîne C8 du film anti-avortement « Unplanned » produit par un studio américain évangélique, la ministre déléguée à l’Égalité femmes-hommes Élisabeth Moreno a déclaré que la chaîne s’était « rendue coupable de délit d’entrave », notamment lié au fait que le film énonce une série de contre-vérités à l’encontre de l’avortement. La direction de la chaîne souhaitait avec ce film toucher les familles chrétiennes traditionnelles. Le public n’a pas été au rendez-vous, avec la faible part d’audience réalisée ce soir-là par la chaîne, alors qu’aux États-Unis le film avait eu un succès inattendu.

Anti-IVG film on C8: Moreno accuses the channel of "obstruction"
Following the broadcast of the anti-abortion film "Unplanned" by the C8 channel, produced by an American evangelical studio, the Minister for Equality between Women and Men, Elisabeth Moreno, declared that the channel was "guilty of obstructionism", in particular because the film stated a series of untruths against abortion. Samuel Goujon, créateur du site « Ils sont partout » recensant les personnalités supposées de confessions juives, a été mis en examen « pour injure publique à raison de l’origine, de l’appartenance à une ethnie, une race ou une religion, provocation publique à la discrimination, à la haine, à la violence et provocation publique à commettre des atteintes volontaires à la vie » et placé sous contrôle judiciaire. Avant d’avoir fait l’objet d’un signalement par le ministre de l’Intérieur Gérald Darmanin, le site avait été repéré par le pôle « haine en ligne » du parquet de Paris qui avait confié les investigations à la Brigade de répression de la délinquance à la personne (BRDP). Le site internet a depuis été fermé.

The creator of the anti-Semitic website "Ils sont partout" is under investigation
Samuel Goujon, creator of the website "Ils sont partout" (They are everywhere), which lists supposedly Jewish personalities, was charged with "public insult on the grounds of origin, belonging to an ethnic group, race or religion, public provocation to discrimination, hatred, violence and public provocation to commit intentional attacks on life" and placed under judicial supervision. Before being reported by the Minister of the Interior Gérald Darmanin, the website had been identified by the "online hate" unit of the Paris public prosecutor's office, which had entrusted the investigations to the Brigade de répression de la délinquance à la personne (BRDP). The website has since been closed.

"Interdire le salafisme", la promesse intenable de Xavier Bertrand
Après avoir accusé de naïveté Emmanuel Macron au sujet de l’islamisme, le candidat à l’élection présidentielle Xavier Bertrand a appelé au cours d’une interview au Journal du Dimanche le 22 août dernier à interdire le salafisme en dissolvant « immédiatement toutes les organisations islamistes qui propagent une idéologie politique incompatible avec les valeurs que nous portons ». Emmanuel Tawil, maître de conférences de droit public à l’Université Paris II et membre de la Commission consultative des cultes, rappelle qu’en l’état actuel de notre droit cela serait « très difficile » d’appliquer une telle mesure et reviendrait à poser un cadre très clair de ce qui relève du radicalisme religieux ou non, chose en soi très difficile. Il rappelle qu’on ne peut imposer en France la primauté des lois de la République au nom de la liberté de conscience, mais simplement leur respect inconditionnel. L’universitaire souligne que « La lettre de l’Ancien et du Nouveau Testament risquerait d'être aussi visé, ce qui non seulement serait ridicule, mais surtout reviendrait à négliger l’importance de l’interprétation des textes ».

"Banning Salafism", the untenable promise of Xavier Bertrand
After accusing Emmanuel Macron of naivety on the subject of Islamism, presidential candidate Xavier Bertrand called in an interview with the Journal du Dimanche on 22 August for a ban on Salafism by "immediately dissolving all Islamist organisations that propagate a political ideology that is incompatible with the values we hold. Emmanuel Tawil, lecturer in public law at the University of Paris II and member of the Consultative Commission on Religious Denominations, reminds us that in the current state of our law it would be "very difficult" to apply such a measure and would amount to establishing a very clear framework of what is or is not religious radicalism, which in itself is very difficult. He reminds us that the primacy of the laws of the Republic cannot be imposed in France in the name of freedom of conscience, but simply their unconditional respect. The academic stresses that "the letter of the Old and New Testaments would also risk being targeted, which would not only be ridiculous, but above all would be tantamount to neglecting the importance of the interpretation of the texts.

Jean-Marie Burguburu, président de la Commission nationale consultative des droits de l’homme, rappelle le « devoir républicain » de la France à accueillir les réfugiés afghans étant donné que le droit d’asile est inscrit dans la constitution (préambule de la Constitution de 1946). Il en appelle aussi au devoir moral de la France, patrie des droits de l’Homme qui se doit d’être « à la hauteur » et de ne pas rechigner à l’accueil de ces réfugiés.

Jean-Marie Burguburu, President of the National Consultative Commission on Human Rights, recalled France's "republican duty" to welcome Afghan refugees, given that the right to asylum is enshrined in the constitution (preamble to the 1946 Constitution). He also appealed to the moral duty of France, the country of human rights, which must be "up to the task" and not shy away from welcoming these refugees.
